In 2014, the law that authorizes marriage leave came into force, while in 2017 it was also added to the Civil Union Agreement (AUC). This is a benefit, which although it has unchanged conditions, it is a relief for the bride and groom in the countdown to celebrate their nuptials.

    What is marriage leave?

    In accordance with Law 20.764, Article 207 bis of the Labor Code, you will have marriage leave entitlement any worker who joins in a religious or civil marriage, or who enters into a Civil Union Agreement, i.e., will have days off, in addition to the annual holiday or vacation period.

    This leave covers all workers, both private and public, in a work dependency relationship and who are covered by a social security system, as well as those who work at home, which is an increasingly recurrent modality since the outbreak of the pandemic. It does not matter if the contract is permanent or indefinite.

    This permit only excludes fee workers, since they work for professional services and are not subject to a collective bargaining agreement. In addition, fee workers are not governed by the Labor Code, but by the Civil Code.

    Marriage leave corresponds to five continuous working days of paid leave. It is a benefit that may be used, at the employee's choice, on the day of the marriage or Civil Union Agreement, and on the days immediately before or after the celebration.

    On the other hand, the regulation states that marriage leave days are working days, excluding Saturdays, Sundays and public holidays within the period chosen by the employee.

    Marriage leave in Chile cannot be exercised at a time other than that established, nor can it be split up or accumulated, for example, with vacation time. If the leave is not taken when it is due, those paid days off will simply be lost.

    How to get a marriage license?

    To assert this right, the worker must give notice to his employer thirty days in advance Ideally, this should be done in writing, so that there is a record of the request, so it is advisable to submit a letter of permission to marry.

    In addition, within thirty days following the celebration, the worker must show the respective marriage certificate or Civil Union Agreement, issued by the Civil Registry and Identification Service.

    What happens if the employer refuses?

    In case of non-compliance with this permission of days off for marriage, the labor law imposes fines of 51, 102 and 153 UTM. And these amounts can be doubled, in case of recidivism, for companies that have between 1 and 49; 50 and 199; and 200 or more workers, respectively.

    Therefore, if you ask for civil, religious or AUC marriage leave with adequate notice and it is not granted, you can go to the nearest Labour Inspectorate office to report it.

    Like birth or bereavement leave, marriage leave responds to a specific life event and must be used when that event occurs, in this case marriage.
