Amendments to the law

Under the old marriage law, a man could remarry immediately after the divorce was registered in the Civil Registry, but a woman could not remarry before giving birth if she was pregnant. Or, even if she showed no signs of pregnancy, she had to wait 270 days from the date of execution of the sentence. This rule of the Civil Code was a measure offamily protection, in order to avoid confusion about paternity.

However, Law No. 21.264, published in September 2020 in the Official Gazette, abolished this obsolete regulation, superseded by science. What does it mean? It means that women, like men, can remarry immediately after separation, annulment or widowhood.

Remarriage in the Catholic Church

The sacrament of marriage is considered an indissoluble bond by the Catholic Church, with the only possibility of undoing it in the case of death of one of the spouses. But Catholicism does not recognize divorce and, therefore, it is not possible to marry a second time.

Only then will the previous marriage become invalid. But if they cannot obtain a nullity, they can always resort to a symbolic ceremony, such as a blessing of rings by a priest or a deacon. Although they will not be married bysecond time under God's laws, so they can give a more spiritual aspect to their civil union.

Most remarriages take place in civil ceremonies, so they tend to be intimate gatherings with family and close friends, which is why some couples choose to celebrate in their own home, although there are also those who prefer to have the wedding reception in a restaurant.
